If you do choose to use our website and the services that are provided through it, that constitutes your agreement of these terms and additional terms, guidelines, documents, policies and rules that are referred to in these terms.
By agreeing to these Terms Of Service you represent that you are at least 18 years of age and can form legally binding contracts to use our service.
Holtsee Australia reserves the right to revise and update these Terms of Service at anytime. For that reason, please check these terms regularly. As above, continued use of our website means that you accept any new or updated Terms of Service.
Throughout the Terms of Service and the Holtsee Australia website, “we”, “us” and “our” refer to Holtsee Australia.
Holtsee Australia is committed to the protection of your personal information in accordance with the Privacy Act 1988 (Cth) (the Privacy Act) and the Australian Privacy Principles which govern the way in which organisations like Holtsee hold, use and disclose personal information
We only collect information which is necessary to provide you with services or appropriately manage and conduct our business.
Consistent with the provision of our products, services and purposes connected to those products and services, the types of personal information we may collect include:
- Your identity and contact details - includes your name, date of birth, email address, home address, delivery address and your contact telephone numbers.
- Your payment details - payment card details/bank details
Your payment transactions are encrypted by the acquiring bank so therefore Holtsee Australia will not retain any payment card details submitted by you.
- Other information - prescription information
Personal information is held securely and none of the information is going to servers located overseas.
We will not use or disclose personal information for any secondary purpose unless that secondary purpose is related to the primary purpose for which we have collected that information.
The purpose for which we hold, use, disclose and process information include conducting our business which includes providing our services, or the services of a third party to you, to communicate information about our products and services or third party products or services that may be of interest to you, and to maintain the safety and security of our business operations.
CHANGES TO OUR SERVICE, PRODUCTS AND PRICES
We reserve the right to modify, change or discontinue products or services without notice at any time.

USER SUBMITTED CONTENT
‘User Content’ is any public communications or any other material you submit or post to Holtsee Australia through our services, website or our pages on third party sites such as Instagram, Facebook and Twitter.
We love our Holtsee tribe and we absolutely love it when you submit and share content through our website or on our social media pages.
When you submit, distribute or post any communications or any other material to Holtsee Australia, whether through our website or a third party site like Instagram, Facebook or Twitter, you, the user, give us the right and licence to use, publish, edit, copy, display and distribute your User Content without any compensation even if we are using it for promotional purposes.
When you submit User Content, you represent and warrant that:
- you hold all necessary right, title, and license to such materials, in other words, you own it or have the right to give it to us.
- your submission of such content to Holtsee Australia does not and, when used by Holtsee Australia as authorised under these Terms, will not violate or infringe the rights of any third-parties, including any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.
- all User Content you provide is accurate, complete, up-to-date, and not misleading
In addition, any User Content must not:
- include any profanity or obscene, indecent, or pornographic material.
- contain any unauthorised or unsolicited advertising, such as spam
- contain software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit, or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any system, data, password, or other information of ours or of any third party.

- include anyone’s identification documents or sensitive financial information.
The bottom line is that if you share something with us, you keep ownership of it but you allow us and other uses to use your User Content. If you do not agree to these terms, please do not provide the content to us.
We are committed to ensuring all our products, frames and glasses are of a high quality which means on the off chance that something goes wrong, we will replace any Holtsee Australia frames or glasses within 12 months of purchase where the product is faulty as the result of any manufacturing or material defect in the product.
We will not warranty minor damage that occurs as a result of ordinary use or damage that occurs as a result of misuse of the products, frames or glasses.
It is the responsibility of you, the owner, to ensure regular care of the product to avoid damage. This includes hinge screws. Although we use lock-tight screws and every care is taken to ensure screws remain tight, they may loosen with wear. We recommend regular maintenance to ensure all parts of our product remain secure. Lack of regular maintenance may result in lens or frame damage which may not be covered by this warranty.

REFUNDS, RETURNS, EXCHANGES
If you aren’t totally in love with your new glasses, we have a 30-day, hassle free return or exchange policy. We want you to be happy!
We will give you a full refund or exchange within 30 days of receipt as long as the item is returned in its original condition with packaging intact
All refunds will be credited to the original payment method.
If you would like to return or exchange a product just email our team at email@example.com and they will be happy to help you.
CANCELLATION OF ORDER
Changed your mind.... no worries, it happens to us all
You can cancel your order right up until it is due to be shipped to you at no charge.
To do so, flick an email to firstname.lastname@example.org with your name, contact details and your order number.
If everything is in order, we’ll provide a full refund in accordance with these terms.
POSTAGE AND SHIPPING
We charge $8.00 on all Australian orders for standard shipping.
If you want our products to get to you faster, Express shipping is charged to you at $11.30 Australia-wide.
In Australia, we use Australia Post to get your glasses to you. Once your order has left our hands, standard delivery can take up to 7 business days. Express shipping usually takes up to 2 business days to be delivered.
As soon as your order has left us, we'll send you a shipping notification email to keep you in the loop. For Australian deliveries the email will contain your Australia Post tracking number so you can track the progress of your order through the Australia Post website.
Don't worry if it doesn't work immediately - it often takes up to 4 hours for it to be searchable in the system.
For our beautiful cousins across the ditch, all New Zealand orders are charged at $20.00 shipping.
All other international orders are charged at $30.00.
SALES AND DISCOUNTS
Sometimes we offer discounted prices and sales on our website.
These are at our sole discretion and may change without notice.
For some lucky customers, at times we may also offer discount codes that entitle a person to a special price or offer. These codes are only to be used by the intended bearer and for the purpose indicated when the code is given by Holtsee Australia.
We reserve the right to cancel any codes or offer for any reason and without any notice.
TRY AT HOME SERVICE
We offer a free, five-day Try at Home service to help you pick your perfect frames. You can choose five frames (which are sent with non-prescription lenses) to try on at home for a five-day period (the “Try-On Period”). For more information about our Try at Home service, click here. If the Try-On Period ends and any of the frames have not been placed in the mail, or the frames are returned damaged, we may charge your credit card for the full amount of each pair of frames that are missing or damaged, as explained in more detail here. By submitting your Try at Home order, you authorise Holtsee Australia to charge your card, and you agree to all other terms of our Home Try-On program explained on our here. Currently, our Home Try-On program is only available to customers who live in Australia.
If you are ordering a frame that requires a prescription to be filled by our Optical Fitting Lab provider, then ‘you’ the customer, warrant that the script information you are giving Holtsee Australia, comes from a non-expired prescription that was validly provided to you by an eligible/registered Optometrist or Ophthalmologist.
Holtsee Australia cannot process prescription orders through our Optical Fitting Lab provider using expired or incomplete prescriptions.
DISCLAIMER & LIMITATION OF LIABILITY
We do not warrant that the results that may be obtained from the use of our service or products, will be accurate or reliable.
You, the user, should consult an eye care professional for regular eye examinations.
You agree that your use of our service and products, is at your own risk and by voluntarily wearing our product, you assume the risk of any resulting injury.
We are not liable for any harm or damages related to the purchase or use of our products, services and user content.
You agree to indemnify and hold harmless Holtsee Australia and our directors, partners, affiliates, suppliers, manufacturers, service providers and employees, from any claim, cost, expense, charge or demand.
